Sub: Implementation of Supreme Court judgment of 12 Apr 2018
Respected Chief Minister Sir,
In continuation of AIPEF letter No 60 dated 30 July, AIPEF is to inform that the Ministry of Power has taken immediate steps to implement the supreme court judgment of 12 Apr 2018 , in view of the Contempt of Court petition heard on 27 July.
2. The Supreme Court in its order of 27th July had issued time bound directions to Secretary Power GoI for compliance by 07 Aug 2020 (Annex 1). The Ministry of Power has complied by issuing a revised Vacancy Circular on 01 Aug (Annex 2) wherein the qualifications for Member(law) CERC have been revised. Vide para 3 and 4 of MoP vacancy Circular (annex 2) it has been made clear that this revision is in compliance of Supreme Court directions.
3. The directions of the Supreme Court are equally valid in cases of States which are to fill vacancies in SERCs. The Supreme Court order of 12 April 2018 is equally applicable to the States for SERC appointments as to the Centre for CERC appointments. The concerned offices/departments in States may kindly be apprised for compliance .
